Terms of Service

1. Acceptance of Terms
By accessing or using Kapture ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Platform.
2. The Platform
Kapture is a marketplace connecting clients with freelance visual creators, including photographers, videographers, designers, and editors. We facilitate discovery, communication, and payment — we are not a party to any contract formed between clients and creators.
3. Accounts
You must be 18 or older to create an account. You are responsible for maintaining the security of your account credentials. Kapture reserves the right to suspend or terminate accounts that violate these terms.
4. Creator Accounts
Creators must apply and be approved before offering services on the Platform. Kapture may revoke creator status at any time for violations of community standards, fraudulent activity, or failure to deliver agreed services.
5. Payments and Fees
All payments are processed through Stripe. Kapture charges a platform fee on each completed transaction. Detailed fee schedules are available in your account settings. Funds are held in escrow until project milestones are approved.
6. Prohibited Conduct
You may not use the Platform for illegal activity, harassment, spam, or circumventing our payment system. Off-platform transactions to avoid fees are prohibited and may result in account termination.
7. Intellectual Property
Creators retain copyright in their work until full payment is received and ownership is explicitly transferred as agreed in the project brief. Kapture claims no ownership over user-generated content.
8. Limitation of Liability
Kapture is not liable for disputes between clients and creators, the quality of delivered work, or any indirect damages arising from use of the Platform. Our total liability is limited to fees paid to Kapture in the preceding 12 months.
9. Changes to Terms
We may update these terms at any time. Continued use of the Platform after changes constitutes acceptance of the new terms.
